Algemene voorwaarden
1. Wie en wat
Deze voorwaarden gelden tussen [Pleksy B.V. i.o.] (Pleksy) en de onderneming die Pleksy gebruikt (de zaak). Pleksy is boekingssoftware voor kappers en salons: agenda, behandelingen, medewerkers, klanten, wachtlijst en automatische aanbiedingen van vrijgekomen plekken per WhatsApp, sms of e-mail. Klanten boeken via een openbare boekingspagina.
Pleksy is alleen bedoeld voor zakelijk gebruik. Consumentenrecht is niet van toepassing op de overeenkomst met de zaak.
2. Account
- U bent minimaal 18 jaar en bevoegd om de zaak te vertegenwoordigen.
- Houd uw inloggegevens geheim. U bent verantwoordelijk voor alles wat via uw account gebeurt.
- Door een zaak aan te maken gaat u akkoord met deze voorwaarden en met de verwerkersovereenkomst. Versie en tijdstip van het akkoord worden vastgelegd.
3. Uw verplichtingen
- U bent verwerkingsverantwoordelijke voor uw klantgegevens en zorgt voor een geldige grondslag.
- U stuurt berichten voor aanbiedingen alleen aan klanten die daarvoor toestemming hebben gegeven. Pleksy legt die toestemming per kanaal vast en voegt in elk bericht een STOP-link toe. U schakelt die niet uit en omzeilt haar niet.
- U gebruikt Pleksy niet voor spam, onrechtmatige inhoud of misbruik, en niet om de dienst te verstoren.
- U houdt uw gegevens juist en actueel.
4. De dienst
- Pleksy levert de dienst met redelijke zorg, maar zonder garantie dat die ononderbroken of foutloos is.
- Het selecteren van wie een aanbieding krijgt, is automatisch en een hulpmiddel. Pleksy garandeert niet dat een vrijgekomen plek wordt gevuld.
- Kanalen als WhatsApp en sms zijn pas beschikbaar wanneer ze zijn ingeschakeld. Bezorging hangt af van derden.
- Pleksy mag de dienst wijzigen. Bij belangrijke wijzigingen laten wij dat vooraf weten.
5. Prijs en betaling
Tijdens de pilot is Pleksy gratis. Daarna geldt de prijs van het gekozen abonnement: [prijs/price per plan]. Pleksy kondigt prijswijzigingen of het einde van de pilot minimaal [30] dagen vooraf aan. Facturatie- en betalingsvoorwaarden: [nog in te vullen].
6. Uw gegevens
De klantenlijst en alle gegevens die u invoert blijven van u. U kunt de hele zaak exporteren en wissen in Instellingen. Pleksy verwerkt klantgegevens als verwerker volgens de verwerkersovereenkomst. Zie ook de privacyverklaring.
7. Intellectueel eigendom
Pleksy en haar licentiegevers houden alle rechten op de software en het merk. U krijgt een niet-exclusief, niet-overdraagbaar gebruiksrecht voor de duur van de overeenkomst.
8. Aansprakelijkheid
De aansprakelijkheid van Pleksy is beperkt tot [maximaal bedrag / aansprakelijkheidsplafond: nog in te vullen]. Pleksy is niet aansprakelijk voor indirecte schade, zoals gemiste omzet of gemiste afspraken. Deze beperking geldt niet bij opzet of bewuste roekeloosheid, of voor zover de wet dat niet toestaat. 9. Duur en einde
- De overeenkomst loopt tot opzegging door een van beide partijen. U kunt opzeggen door de zaak te wissen of per e-mail: [support@pleksy.eu]. Opzeggingstermijn: [nog in te vullen].
- Pleksy mag een account opschorten of beëindigen bij ernstige schending van deze voorwaarden.
- Na het einde wissen wij de zaakgegevens binnen [30] dagen, tenzij u ze eerst exporteert.
10. Toepasselijk recht
Nederlands recht is van toepassing. Geschillen gaan naar de bevoegde rechter van [rechtbank].

Terms of service
1. Who and what
These terms apply between [Pleksy B.V. i.o.] (Pleksy) and the business that uses Pleksy (the shop). Pleksy is booking software for barbers and salons: agenda, services, staff, clients, a waitlist, and automatic offers of freed-up slots by WhatsApp, SMS or email. Clients book through a public booking page.
Pleksy is for business use only. Consumer law does not apply to the contract with the shop.
2. Account
- You are at least 18 years old and authorised to represent the shop.
- Keep your sign-in details secret. You are responsible for everything done through your account.
- By creating a shop you accept these terms and the data processing agreement. The version and timestamp of your acceptance are logged.
3. Your obligations
- You are the controller of your client data and make sure you have a valid legal basis.
- You send offer messages only to clients who have given consent. Pleksy logs that consent per channel and adds a STOP link to every message. You do not disable or circumvent it.
- You do not use Pleksy for spam, unlawful content or abuse, or to disrupt the service.
- You keep your data accurate and up to date.
4. The service
- Pleksy provides the service with reasonable care but does not guarantee that it is uninterrupted or error-free.
- Selecting who receives an offer is automatic and a tool. Pleksy does not guarantee that a freed-up slot will be filled.
- Channels such as WhatsApp and SMS are available only once enabled. Delivery depends on third parties.
- Pleksy may change the service. We will give notice in advance of material changes.
5. Price and payment
Pleksy is free during the pilot. After that, the price of the chosen plan applies: [prijs/price per plan]. Pleksy will announce price changes or the end of the pilot at least [30] days in advance. Invoicing and payment terms: [to be added].
6. Your data
The client list and all data you enter remain yours. You can export and erase the whole shop in Settings. Pleksy processes client data as processor under the data processing agreement. See also the privacy notice.
7. Intellectual property
Pleksy and its licensors keep all rights in the software and the brand. You get a non-exclusive, non-transferable right to use it for the duration of the contract.
8. Liability
Pleksy's liability is capped at [maximum amount / liability cap: to be added]. Pleksy is not liable for indirect loss, such as lost revenue or missed appointments. This limit does not apply to intent or deliberate recklessness, or where the law does not allow it. [Legal review needed.]
9. Term and ending
- The contract runs until either party ends it. You can end it by erasing the shop or by email: [support@pleksy.eu]. Notice period: [to be added].
- Pleksy may suspend or end an account for serious breach of these terms.
- After the contract ends we delete the shop data within [30] days, unless you export it first.
10. Governing law
Dutch law applies. Disputes go to the competent court of [rechtbank].
